Il suo difetto pu\u00f2 infatti comportare gravi rischi per la salute delle categorie vulnerabili di consumatori (reazioni immuni e choc anafilattici di esito anche letale in caso di allergie, patologie di gravit\u00e0 crescente per le intolleranze). (2)<\/p>\n<p><strong>Il regolamento \u2018<em>Food Information to Consumers<\/em>\u2019<\/strong>\u00a0ha rafforzato la protezione dei consumatori allergici e intolleranti sotto due aspetti:<\/p>\n<p>&#8211; introduzione dell\u2019<a href=\"http:\/\/www.foodagriculturerequirements.com\/evidenza-grafica-dei-soli-ingredienti-allergenici-in-etichetta-risponde-lavvocato-dario-dongo\/\" target=\"_blank\" rel=\"noopener\">obbligo di attribuire evidenza grafica<\/a> alle parole-chiave dei singoli allergeni, in modo da agevolarne l\u2019identificazione nella lettura della lista ingredienti,<\/p>\n<p>&#8211; estensione del dovere inderogabile d\u2019informazione specifica a tutti gli alimenti, quand\u2019anche venduti sfusi o preincartati, ovvero <a href=\"http:\/\/www.foodagriculturerequirements.com\/europa-allergeni-nei-pubblici-esercizi-il-memento-del-min-sal\/\" target=\"_blank\" rel=\"noopener\">somministrati nei pubblici esercizi<\/a> (ivi <a href=\"http:\/\/www.foodagriculturerequirements.com\/allergeni-nel-catering-risponde-lavvocato-dario-dongo\/\" target=\"_blank\" rel=\"noopener\">comprese le attivit\u00e0 di <em>catering<\/em><\/a>).<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Il_caso_Lindt_Sprungli\"><\/span>Il caso\u00a0Lindt &amp; Spr\u00fcngli<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><strong>Prosegue l\u2019esame\u00a0di etichette<\/strong>\u00a0a marchi blasonati, come Mulino Bianco e Nestl\u00e9, non conformi alle regole europee di informazione specifica in tema di allergeni.<\/p>\n<p><a href=\"http:\/\/www.foodtimes.eu\/wp-content\/uploads\/2017\/12\/lindt.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-29450 size-full\" src=\"http:\/\/www.foodtimes.eu\/wp-content\/uploads\/2017\/12\/lindt.jpg\" alt=\"\" width=\"500\" height=\"350\" srcset=\"https:\/\/www.foodtimes.eu\/wp-content\/uploads\/2017\/12\/lindt.jpg 500w, https:\/\/www.foodtimes.eu\/wp-content\/uploads\/2017\/12\/lindt-300x210.jpg 300w, https:\/\/www.foodtimes.eu\/wp-content\/uploads\/2017\/12\/lindt-150x105.jpg 150w\" sizes=\"auto, (max-width: 500px) 100vw, 500px\" \/><\/a><\/p>\n<p><strong>La situazione si ripete con Lindt &amp; Spr\u00fcngli<\/strong>, laddove addirittura il cioccolato \u201899% cacao\u2019 pu\u00f2 contenere \u2018frutta a guscio\u2019, non meglio identificata, oltre a latte e persino soia.<\/p>\n<p><strong>\u00c8 sempre utile denunciare l\u2019<a href=\"http:\/\/www.foodagriculturerequirements.com\/mix-di-frutta-secca-e-solfiti-questione-allergeni-risponde-lavvocato-dario-dongo\/\" target=\"_blank\" rel=\"noopener\">illegittimit\u00e0<\/a><\/strong>\u00a0del riferimento generico alla frutta a guscio, stigmatizzato da ultimo nelle Linee guida della Commissione europea. Con l\u2019invito alle autorit\u00e0 sanitarie competenti a risvegliarsi da un oblio gi\u00e0 durato una dozzina d\u2019anni e perci\u00f2 non ulteriormente tollerabile.<\/p>\n<p>\u00c8 tempo che ciascuno assuma le proprie responsabilit\u00e0. Gli operatori, su entrambi fronti di autocontrollo e informazione al consumatore. <a href=\"http:\/\/www.foodagriculturerequirements.com\/allergeni-tracce-e-sanzioni-risponde-lavvocato-dario-dongo\/\" target=\"_blank\" rel=\"noopener\">Gli enti di controllo, su prescrizioni e sanzioni<\/a>.<\/p>\n<p><em>Dario Dongo<\/em><\/p>\n<p><strong>Note<\/strong><\/p>\n<p>(1) Al di fuori dei soli prodotti derivati da ingredienti allergenici espressamente esclusi dagli obblighi di informazione specifica, ai sensi del\u00a0reg. UE 1169\/11,\u00a0Allegato II. A seguito di valutazioni scientifiche dell\u2019Efsa, che ha accertato l\u2019incapacit\u00e0 di alcune sostanze &#8211; pur derivate da ingredienti allergenici &#8211; di innescare reazioni patologiche nel soggetti sensibili alle loro materie prime<\/p>\n<p>(2) Il prodotto alimentare recante notizie inesatte sulla presenza di allergeni si qualifica perci\u00f2 come alimento a rischio di sicurezza alimentare, ai sensi del\u00a0reg.
