Nostra segnalazione all\u2019<\/span><\/span><\/span><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\">ASL\u00a0e all\u2019Antitrust.<\/span><\/span><\/span><\/p>\n<h4><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\"><i><b>&#8216;Nutrition &amp; Health Claims<\/b><\/i><\/span><span style=\"font-size: medium;\">\u2019<\/span><span style=\"font-size: medium;\"><b>, le regole in UE<\/b><\/span><\/span><\/span><\/h4>\n<p><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\"><b>Il regolamento \u2018<\/b><i><b>Nutrition &amp; Health Claims\u2019\u00a0<\/b><\/i>(NHC) ha introdotto una disciplina generale e armonizzata dell\u2019impiego di indicazioni nutrizionali e sulla salute nell\u2019informazione commerciale relativa agli alimenti. (1) Ogni notizia volontaria che possa anche solo implicitamente suggerire le propriet\u00e0 nutrizionali di un alimento (o\u00a0<\/span><\/span><\/span><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\">di un ingrediente) ovvero il legame tra il suo consumo e un beneficio per la salute deve sottostare alle regole in esame. In particolare:<\/span><\/span><\/span><\/p>\n<p><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\"><b>&#8211;\u00a0<\/b><\/span><\/span><\/span><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\"><i><b>nutrition claim<\/b><\/i><\/span><\/span><\/span><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\">. Le indicazioni nutrizionali<\/span><\/span><\/span><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\">\u00a0ammesse sono soltanto quelle di cui in Allegato al regolamento CE 1924\/06, alle condizioni ivi previste. Si citano a esempio le indicazioni ammesse sui c.d. \u2018grassi buoni\u2019<\/span><\/span><\/span><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\">,<\/span><\/span><\/span><\/p>\n<p><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\"><i><b>&#8211; health claim<\/b><\/i><\/span><\/span><\/span><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\">. Le sole indicazioni sulla salute ammesse in etichetta e pubblicit\u00e0 degli alimenti sono quelle autorizzate dalla Commissione europea in accordo con gli Stati membri, a seguito di appositi pareri dell\u2019Efsa. (2)\u00a0Si vedano a esempio le virt\u00f9 ammesse su alimenti che contengano ferro<\/span><\/span><\/span><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\">.<\/span><\/span><\/span><\/p>\n<p><span style=\"color: #ff0000; font-size: medium;\"><span style=\"font-family: Arial, sans-serif;\">\u2018<i><b>Un marchio<\/b><\/i><i>, denominazione commerciale o denominazione di fantasia riportato sull&#8217;etichettatura, nella presentazione o nella pubblicit\u00e0 di un prodotto alimentare che pu\u00f2 essere interpretato come indicazione nutrizionale o sulla salute pu\u00f2 essere utilizzato senza essere soggetto alle procedure di autorizzazione previste dal presente regolamento a condizione che l&#8217;etichettatura, presentazione o pubblicit\u00e0 rechino anche una corrispondente indicazione nutrizionale o sulla salute conforme alle disposizioni del presente regolamento<\/i>\u2019 (reg. CE 1924\/06, articolo 1.3). (3)<\/span><\/span><\/p>\n<h4><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\"><i><b>&#8216;Nutrition &amp; Health Claims<\/b><\/i><\/span><span style=\"font-size: medium;\">\u2019<\/span><span style=\"font-size: medium;\"><b>, le sanzioni<\/b><\/span><\/span><\/span><\/h4>\n<p><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\"><b>Le sanzioni amministrative<\/b><\/span><\/span><\/span><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\">\u00a0specifiche per le violazioni delle citate regole sono state introdotte in Italia l\u20191.4.17. (4) Meglio tardi che mai, dopo oltre 10 anni dall\u2019entrata in vigore del regolamento NHC (<\/span><\/span><\/span><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\"><i>Nutrition &amp; Health Claims<\/i><\/span><\/span><\/span><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\">). Nel corso degli anni, alcune pratiche commerciali scorrette sono state sanzionate dall\u2019AGCM (Autorit\u00e0 Garante per la Concorrenza e il Mercato, c.d. Antitrust).<\/span><\/span><\/span><\/p>\n<p><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\"><b>La situazione in Italia<\/b><\/span><\/span><\/span><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\">\u00a0\u00e8 a tutt\u2019oggi critica. Si riscontrano infatti gravi violazioni delle regole vigenti anche su prodotti a marchio di grandi gruppi, nell\u2019industria e in GDO (come si \u00e8 annotato in una recente indagine di mercato sulla frutta secca<\/span><\/span><\/span><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\">). Oltrech\u00e9 su <a href=\"https:\/\/www.foodagriculturerequirements.com\/notizie\/domande-e-risposte\/fare-pane-viola-per-diabetici-e-obesi-magari-no-risponde-lavvocato-dario-dongo\">semilavorati<\/a><\/span><\/span><\/span><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\">\u00a0e prodotti che circolano su canali diversi. Farmacie, parafarmacie, vendite piramidali ed ecommerce.<\/span><\/span><\/span><\/p>\n<p><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\"><b>Il nostro Paese<\/b>\u00a0sembra essere una \u2018terra di nessuno\u2019, ove i rischi di contestazioni sono tuttora considerati risibili rispetto agli indebiti profitti che vengono invece portati avanti attraverso etichette illecite e fraudolente. A discapito dei consumAttori, sotto il silenzio del Ministero della Salute e delle ASL (su cui ricade la competenza a vigilare l\u2019applicazione del regolamento NHC, secondo quanto prescritto dal d.lgs. 27\/17).<\/span><\/span><\/span><\/p>\n<h4><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\"><i><b>&#8216;sanOil<\/b><\/i><\/span><span style=\"font-size: medium;\">\u2019<\/span><span style=\"font-size: medium;\"><b>, il marchio sulle patatine San Carlo<\/b><\/span><\/span><\/span><\/h4>\n<p><span style=\"color: #222222;\">\u2018<span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\"><i><b>sanOil, un\u2019accurata selezione di oli vegetali di qualit\u00e0 eccellente\u2019<\/b><\/i><\/span><span style=\"font-size: medium;\">\u00a0\u00e8 la dicitura che compare su diverse confezioni di patatine San Carlo. Il carattere minuscolo della prima lettera &#8211; \u2018<\/span><span style=\"font-size: medium;\"><i>san<\/i><\/span><span style=\"font-size: medium;\">\u2019 come \u2018<\/span><span style=\"font-size: medium;\"><i>sano<\/i><\/span><span style=\"font-size: medium;\">\u2019 e non \u2018<\/span><span style=\"font-size: medium;\"><i>San<\/i><\/span><span style=\"font-size: medium;\">\u2019 come \u2018<\/span><span style=\"font-size: medium;\"><i>San Carlo<\/i><\/span><span style=\"font-size: medium;\">\u2019 &#8211; sgomina il campo da azzardate teorie sull\u2019ipotetica assonanza dei marchi, i quali tra l\u2019altro hanno grafiche ben distinte. E la parola \u2018<\/span><span style=\"font-size: medium;\"><i>sano<\/i><\/span><span style=\"font-size: medium;\">\u2019, ironia della sorte, compare a pochi centimetri di distanza da \u2018<\/span><span style=\"font-size: medium;\"><i>sanOil<\/i><\/span><span style=\"font-size: medium;\">\u2019, sulla colonna sinistra della retro-etichetta, riferita a uno \u2018<\/span><span style=\"font-size: medium;\"><i>stile di vita<\/i><\/span><span style=\"font-size: medium;\">\u2019. (5)<\/span><\/span><\/span><\/p>\n\n<p>&nbsp;<\/p>\n<p><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\"><b>Il marchio \u2018<\/b><i><b>sanOil<\/b><\/i>\u2019\u00a0risulta essere stato registrato da San Carlo Gruppo Alimentare SpA in data 14.7.09. Non sembra perci\u00f2 potersi applicare la deroga transitoria dall\u2019applicazione del regolamento a NHC, concessa a favore dei marchi esistenti prima dell\u20191.1.05. (6) Sono per\u00f2 trascorsi 10 anni dal suo impiego continuativo (poich\u00e9 altrimenti sarebbe decaduto) che prosegue su prodotti alimentari non provvisti n\u00e9 tantomeno degni di alcuna indicazione nutrizionale n\u00e9 salutistica.<\/span><\/span><\/span><\/p>\n<p><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\"><b>10 anni di inganno<\/b><\/span><\/span><\/span><span style=\"color: #222222;\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: medium;\">\u00a0dei consumatori? Cos\u00ec sembrerebbe. Inoltriamo il presente articolo alle competenti Autorit\u00e0 per i doverosi accertamenti, dopo un lungo letargo.
